Default NumEmpty tag for data sets

I've run into a couple of tile sets that have the first couple of layers missing. For instance, the number of layers may be 15, but the config file will say NumEmpty is 4. When I look at the cache, the data starts at layer 0, but the files in there are actually for layer 4. I can rename the layers to 4 - 14, but then I don't have any data for levels 0, 1, 2, & 3. The problem is the old legacy WWC# has to have all the data from level 0 on. Has anyone got a fix for this? Has anyone either taught the legacy code how to deal with the NumEmpty tag, or convinced it to move on down the imagery even if it is missing the tiles above?
